Accordingly, Ministries/Departments are requiredtoconsultCommissionforframing/amendmentofRRsforGroup‘A’and‘B’postsexceptthosewhichareexemptfromconsultationwithUPSC underUPSC (Exemption from Consultation) Regulations, 1958,asamendedfromtimetotime.2.WhetherRRsnotifiedwithoutconsultationofUPSCarevalid?Asperconstitutionalprovisions,Ministries/DepartmentsarerequiredtoconsultCommissionforframing/amendmentofRRsforallGroup‘A’and‘B’postsexceptthosewhichareexemptedfromconsultationwith UPSC under UPSC (Exemption from Consultation) Regulations,1958, as amended from time to time. In case RRs of any post forwhich consultation with UPSC is required, are notified without itsconsultation,theyaretreatedasNon‐est.3.WhatisRecruitmentandwhatareRecruitmentRules?RecruitmentisaprocessofselectionofcandidatestoadesignatedpostandRecruitmentRulesaretheprovisionsprescribedundertheStatute,forexecutingthesame.TheUPSCisrequiredtoadviseupontheRecruitmentRulesforvariousCivilPostswhicharemandatedtoit, under the Constitution of IndiaoraspecificActgoverningaPage 2

What is the difference between Recruitment Rules & ServiceRules?Service Rules are framed for defined Organized Service(s) to theUnionofIndiaandarecomprehensive statutory documents,whichincludeamongothersthespecificationswithregardto,a. Titleanddefinitionsb. Authorizedstrength&grade(s)c. Initialconstitutionandfuturemaintenanced. Seniority, qualifying service for promotion, probation &methodofrecruitmente. Liabilitiesanddisqualificationf. Relaxationprovisionsg. SavingsclauseRecruitmentRulesareframedforCivilPostswhicharenotcoveredbyOrganizedServices.TheRecruitmentRulesdonotcontainmanyClause(s) of Service Rules of Organized Service(s) and contain aNotification along with a prescribed 13 Columns Schedule. TheSchedule contains details of various provisions such as number ofposts,Classification,PayLevel,MethodofRecruitment,EducationalQualificationsfordirectrecruitsetc.5. What kind of posts are exempt from the purview of mandatoryconsultationwiththeUPSC?Clause3ofArticle320oftheConstitutionofIndiainteraliastipulatesthemattersonwhichUPSCisrequiredtobeconsulted.ProvisotosaidPage 3
RecruitmentRulesBranchFrequentlyAskedQuestions(FAQs)Page4clauseprovidesformakingregulationstospecifythemattersinwhicheithergenerally,orinanyparticularclassorcaseorinanyparticularcircumstances, it shall not be necessary to consult Public ServiceCommission. Accordingly, Government has notified UPSC (Exemptionfrom Consultation) Regulations, 1958, amended from time to time,specifyingtheservicesandpostswhichareexemptedfromconsultationwithUPSCinregardtomattersspecifiedinArticle320.6.WhetherStatutoryOrganizationsarerequiredtoconsultUPSCforframing/amendment of Recruitment Rules to posts under theirjurisdiction?InaccordancewiththemandateassignedunderArticle321oftheConstitution, the Organizations, established under an Act of theParliament, where the requirement of mandatory consultation withthe UPSC is specified under a designated Section of that Act, arerequired to seek the Advice of the UPSC for purpose of framing oramendment of Recruitment Rules to Group A & Group B Civil Postsunder their organization(s). Examples of suchorganizations are:‐theNew Delhi Municipal Council, Municipal Corporation of Delhi,Employees State Insurance Corporation, Employees Provident FundOrganization,DelhiJalBoard,etc.7.WhetherRecruitmentRulesarerequiredtobereviewedperiodically?Recruitment Rules prescribe various specifications relating toclassification of post, pay structure, method of recruitment,composition of Departmental Promotion/ Confirmation Committee(s),Page 4

The change(s) in the cadre structureandessential qualifications to a given post etc., also require dueamendmentsinthespecificcolumn(s)oftheRecruitmentRules.DoP&TguidelinesaccordinglyprovidethattheRecruitmentRulesmaybereviewedonce in every fiveyears,tomake necessary amendmentsasperchangedposition.8. Who are the stakeholders and what is the process involved inframing/amendmentofRRs?a.TheproposalforframingoramendmentofRecruitmentRulesisinitiated by the concerned Administrative Ministry with theapproval ofthe Competent Authority. TheCompetentAuthoritycandelegatethespecifiedpower(s).b.Consequentuponthesaidapproval,theproposalisrequiredtobesubmittedtotheDoP&Tforconcurrence.c. After the concurrence of the DOP&T to the proposal forframing/amendment of recruitment rules, the proposal issubmitted to UPSC for posts/services which come within itspurview. Advice of the UPSC is conveyed to the Ministry /Organizationconcerned.d.TheRecruitmentRulesarethensentbytheconcernedMinistrytotheMinistryofLaw&Justiceforvetting.Page 5

Whether there is any requirement to seek comments ofstakeholders before referring the proposal for framing/amendmentofRecruitmentRulestoDOPT/UPSC.Beforereferringanyproposalforframing/amendmentofRecruitmentRulesofaposttoDOPT,Ministries/Departmentsarerequiredtoputup proposed Recruitment Rules on their website for 30 days forinvitingcommentsfromthestakeholders. Thereafter, taking intoaccountthecommentssoreceived,theproposalistobesent.10.WhatistheSingleWindowSystem(SWS)forreceiptofproposalsintheUPSC?UPSChasintroducedaSingleWindowSystem(SWS)fordiscussingandacceptingtheproposalsforframing/amendmentofRecruitmentRules(RRs)brought byconcerned Ministry/Department.TheAdministrativeMinistry is required to designate an Officer not below the rankofUnder Secretary to bring the proposal under SWS. The UnderSecretaries inRR Branchin theCommission areauthorized to acceptthe proposals from Ministries/Departments assigned to them. Theproposal is evaluated through a preliminary scrutiny, based upon apre‐definedCheck‐list,whichspecifiesthedocumentsandinformationrequiredtobeprovidedalongwithaproposal.Incasetheproposalisfoundtobeincomplete,thereasonsthereofarerecordedon‐the‐spotand intimated to the Official from the Ministry / DepartmentPage 6

Proposals complete in allrespectsareacceptedandprocessedbytheCommission.UPSC has also developed e‐appointment system under SWS toscheduletheappointmentunderSWSforbringingtheproposalw.e.f19.02.2018. The web links for this facility are available athttps://upsconline/miscellaneous/eappointment/src/orhttp://www.upsc.gov.in/single‐window‐system/reruitment‐rules‐branchFurther, Ministries/Departments can submit their proposals forframing/amendment of RRs to DoP&T through Recruitment RulesFormulation,AmendmentandMonitoringSystem(RRFAMS)portal.Withthedevelopment of UPSC module of RRFAMS portalwitheffectfrom 03.12.2018, proposals approved by DoP&T on RRFAMS portalmoveonlinetotheCommissionontheportal.Theproposalspertaining to Service Rules or concerning UTs and statutoryorganizationsetc.,continuetobereceivedunderSWS.11. Whether there is any enabling provision to interact withMinistry/Department in UPSC portal in case any clarification isrequiredontheproposalreceivedonlineontheportal?RRFAMSportalincludesenablingprovisiontoseekclarificationfromDepartmentonline,ifrequired.Ministry/Departmentcanalsouploaddocuments in support of their responses. Further, there ismechanismtocallMinistry/Departmentonlineformeetingatvariouslevels in UPSC to discuss the proposal. Meeting is scheduled onlineand minutes of discussion held in the meeting are also conveyedPage 7
RecruitmentRulesBranchFrequentlyAskedQuestions(FAQs)Page8throughportal.12.WhatistheCheck‐listforsubmittingframing/amendmentproposalstotheCommissionunderSWSoronRRFAMS?UPSChasdevisedaCheck‐listofthepointsonwhichnecessaryinformation/documents are required to be provided while referringproposalstoUPSC.TheCheck‐listisavailableonthewebsiteofUPSC.Itisbeingusedforreceiptofproposalswitheffectfrom01.05.2015.Itcontains points relating to methods of recruitment, submission ofannexures prescribed under DOPT guidelines, covering notification,educationalqualifications,documentsrelatingtocreation,merger,re‐designation of posts etc. Check list facilitates the Departmenttofurnish complete proposal. The points contained in check‐list havebeen incorporated in RRFAMS portal. Accordingly, while submittingproposalsonlineonRRFAMSportal,Departmentisrequiredtofurnishtherelevantinformation/uploadnecessarydocumentsontheportal.13.Whatarethecommondeficienciesobservedintheproposals?The proposals, which are brought for consideration in the SWS orsubmitted onlineon RRFAMSPortal, are generallyfound to have thefollowingdeficiencies:‐a. Approval of the Competent Authority, authorized toapprovethedraftproposal,isnotenclosedb. Relevantdocument(s)requiredundertheCheck‐listoftheSWSarenotenclosedc. CertificateofCourtCase(s)(i.e.,theproposalbeingnotsubjudice/under consideration of any Court), is notPage 8

Educational qualifications are not commensurate withdutiesandresponsibilitiesofpost.f. Ambiguousdomainexperienceinexperienceclause,whichcould result in difficulty of interpretation at the time ofrecruitment.14.Whatisthepurposeofprescribing‘QualifyingService’forpromotiontothenexthigherGrade?QualifyingServiceistheminimumresidencyperiodprescribedintheServiceRules/RecruitmentRulesthatanincumbenthastoserveinaGradeonaregularbasisbeforebeingeligibletobepromotedtothenexthighergrade.15.Whether“equivalence”canbeusedtoprescribeEducationalQualification?DOP&T guidelines dated 31.12.2010 on framing/amendment/relaxation of Recruitment Rules provide that the Ministries/Departments should clearly specify the educational qualificationsandavoidusageoftheterm‘orequivalent’.Ministries/Departmentsare required to clearly prescribe an exhaustive list of educationalqualificationstomatchthedutiesandresponsibilitiesofthepost.16.WhenistheUPSCassociatedwiththeDepartmentalPromotionPage 9

Is the UPSC required to be associated in the DepartmentalConfirmation Committee constituted for considering confirmationofofficers?UPSC is not required to be associated with DepartmentalConfirmationCommitteeforconsideringconfirmation.18. What is one time mode of recruitment and under whatcircumstancesitcanbeconsidered?Incaseofnewlycreatedposts,forwhichRecruitmentRulesarenotyet framed, and posts for whichRRarerepealed,andthesepostsarerequiredtobefilledonurgentbasis, concerned Ministry/Department can make a reference toUPSC for determination of one‐time method of recruitment forfillingupthepostintheabsenceofRecruitmentRules.Thismethodof recruitment is available once only and cannot be used again.Department is required to frame Recruitment Rules in themeantimeforfurtherfillingupofposts.Thismodecannotbeinvoked in cases where Recruitment Rules exist but have becomeinoperableforanyreasons.19.WhatisthedifferencebetweenrelaxationinRecruitmentRulesandonetimemodeofrecruitment?Page 10
